Cannabis and the Law

People across the State of Michigan are seeing the many benefits cannabis has to offer. Gone are the days of dealing with harsh side effects from prescription medications now that patients are experiencing the natural benefits of marijuana. Law makers in the Great Lakes State have created pathways for this to occur. Through the MMFLA (Medical Marihuana Facilities Licensing Act), MMMA (Michigan Medical Marihuana Act), and MRTMA (Michigan Regulation and Taxation of Marihuana Act), citizens can find relief.

The MMMA states that a qualifying patient who has been issued a Medical Marijuana Card “is not subject to arrest, prosecution, or penalty in any manner, or denied any right or privilege.” This includes, and is not limited to, the use of your medicine while on probation. Many courts are still catching up to the ever-changing cannabis laws. In the event you have any issues ensuring you’re compliant with probation and still able to use your medicine, reach out for legal help. You can contact Birka Law, PLLC in Burton, Michigan. Michigan citizens voted to pass proposal one in 2008, legalizing medical marijuana. Following this initial law, in 2016, Michigan’s governor signed to allow medical marijuana dispensaries to operate. Then in 2018, the citizens voted again to allow recreational use of cannabis to anyone the age of 21 or older in the State.

What is Medical Marijuana?

Medical marijuana uses the chemicals from the marijuana plant to treat diseases or conditions. It’s essentially the same product as recreational marijuana, but it’s meant to be taken for medical purposes.

The marijuana plant contains more than 100 different chemicals called cannabinoids – each of which has a different effect on the body. Delta-9-tetrahydrocannabinol (THC) and cannabidiol (CBD) are the main chemicals used in medicine. THC is also known for producing the “high” people feel when they smoke marijuana or eat edibles containing it.
